Abstract:
Este trabalho pretende analisar a importância da proteção dos ecossistemas nacionais como conditio sine qua non para a conservação da diversidade biológica nacional. Da análise teórica do tema, partindo-se dos conceitos legais conferidos a sua nomenclatura-chave (diversidade biológica, ecossistemas e conservação), chega-se a uma abordagem da legislação ambiental brasileira, com destaque ao Código Florestal, no intuito de verificar a eficácia da norma jurídica dentro deste processo. Será a legislação capaz de proteger os ecossistemas e, assim, garantir a conservação da diversidade biológica no Brasil? Diante da amplitude do assunto e da riqueza dos biomas nacionais (florestas – Mata Atlântica e Amazônia –, cerrado, caatinga, etc), o tema será enfocado sob o ponto de vista da conservação das florestas
nacionais, contrapondo as suas necessidades à proteção que lhes dispensa a legislação
nacional, notadamente o Código Florestal (Lei n 4.771, de 15 de setembro de 1995).
This work intends to analyze the importance of the protection to national ecosystems as
conditio sine qua non for the conservation of the national biological diversity. Of the theoretical analysis of the subject, starting of the legal concepts conferred its nomenclature-key (biological diversity, ecosystems and conservation), it is arrived a boarding of the Brazilian ambient
legislation, with prominence to the Forest Code, in intention to inside verify the effectiveness of the rule of law of this process. Will it be the legislation capable to protect ecosystems and, thus, to guarantee the conservation of the biological diversity in Brazil? In face of the amplitude of the subject and the national wealth of biomas (forests – Mata Atlântica and Amazônia –, hedge, scrub savanna, etc), the subject will be focused under the point of view of the conservation the national forests, opposing its necessities to the protection that the national legislation excuses to them, observing the Forest Code (Law n 4,771, of 15 of September of 1995).
