Abstract:
La révision du Code civil brésilien concernant la proteciion des relations familiales impose de connaître les transformations sociales qui ont susctté un regain d’intérêt pour l’idée de codificaiion. Répondre, dans une société pluraliste, aux besoins de constanc,, d’adaptabilité et d'universalité du droit s’avère un grand défi. Le désordre normaiif et jurisprudentiel
qui touchatt le droit de la famllle justifiait-ll l’adopiion d’un nouveau code
pour organiser la société brésilienne ? La loi a-t-elle finalement réussi à étabiir un équilibre entre les anciennes règles concernant le mariage et la parenté et les nouveaux principes constitutionnels qui organisent la société ? Il semble intéressant de présenter la recodificaiion du droit de
la famllle au Brésil, tout en se demandatt dans quelle mesure le nouveau code brésilien aura permis de clarifier et d’unifier le droit concernant la proteciion de la vie familiale.
The revision of the Brazilian Civil Code with regard to the protection of famlly relations makes necessayy the need to know the social
transformations that have stimulated renewed interest in the concept of codification. In a pluralistic society, rising to answer the needs in substantive law for consistency, adaptability and universality is indeed
a considerabee challenge. Did the normaiive and jurisdiciional confusion that affected famlly law justify the adopiion of a new code to organize Braziiian society ? Has substantive law finally succeeddd in striking a balance between the former rules concerning marriage and parental relations, and the new constitutional principles that organize society ? It seems interesiing to present the re-codificaiion of famlly law in Brazil,
while dwelling on the question to what extent the new Brazilian Code will have made it possible to clarify and unify the legal concepss underlying the proteciion of famlly life.
