Abstract:
O estudo desenvolvido trabalha com a existência de uma posição
majoritária do Supremo Tribunal Federal e do Superior Tribunal de
Justiça nas pretensões de fornecimento de serviços de saúde, a partir
da análise do conteúdo das decisões proferidas no período de janeiro
de 2007 a janeiro de 2009. O texto enfoca, principalmente, a luz do
texto constitucional, os direitos fundamentais à vida e à saúde e a
exigência do orçamento público para a efetivação de prestações
positivas. Evidencia-se a ocorrência do conflito entre as normas
constitucionais, decorrente do ajuizamento de ações requerendo a
concessão de prestações de saúde pública, incumbindo ao Poder
Judiciário, através de métodos de interpretação, alcançar o melhor
resultado possível para a solução do caso concreto. Defende-se,
fundamentalmente, a preponderância dos direitos fundamentais à
vida e à saúde em face do direito financeiro e orçamentário nas
demandas para a efetivação de prestações materiais de saúde.
This study approaches the existence of a major position of the
Supreme Federal Court and the Superior Court of Justice in the
claims for health care provision through the analysis of the content of
the decisions pronounced between January, 2007 and January, 2009.
The study focuses mainly on the point of view of the constitutional
text, the fundamental rights to life and health, and the public budget
demand for effective positive provisions. There is evidence of conflict
between the constitutional rules due to the judgment of actions
requiring the grant of public health care provision. Therefore, the
Judiciary must reach the best possible solution of the concrete case through interpretation methods. The preponderance of fundamental
rights to life and health is defended in opposition to the financial and
budgetary right in the demands for effective material provision of
health.
