A crise de identidade da cidadania brasileira : entre a judicialização da política e o ativismo judicial

Abstract

A presente dissertação tem como tema a constituição federal de 1988, o estado democrático de direito e um novo panorama: a crise de identidade da cidadania brasileira frente aos avanços do ativismo judicial no brasil. Para tanto, o presente trabalho fará um breve apanhado histórico quanto as conquistas constitucionais decorrentes do segundo pós-guerra, bem como, quanto ao a atuação do poder judiciário ante a separação dos poderes estatais. Analisar-se-á, ainda, os fenômenos da judicialização da política e do ativismo judicial, os quais embora possuam em comum a expansão do Poder Judiciário sobre os demais poderes, não podem ser confundidos, à medida que o ativismo judicial corresponde a uma postura discricionária e pragmática de juízes e tribunais, que se baseiam em critérios subjetivos no momento de proferir suas decisões. Todavia, tal fenômeno não deve ser admitido pela população brasileira, uma vez que vai de encontro aos ideais democráticos instituídos com a promulgação da Constituição Federal de 1988. Dessa forma, para que o Estado Democrático de Direito se mantenha é preciso afastar-se o decisionismo judicial que tanto assola a cidadania brasileira, pois acaba por tolher direitos e garantias de cidadãos que descrentes de seu papel no Estado, permanecem atônitos ante a essas mudanças causadas pelo ativismo judicial no Brasil.

The present dissertation has asits theme the federal constitution of 1988, the democratic state of law and a new panorama: the identity crisis of Brazilian citizenship in front of the advances of judicial activism in Brazil. To this end, the present work will give a brief historical overview of the constitutional achievements of the second post-war period, as well as the role of the judiciary in the face of the separation of state powers. We will also analyze the phenomena of the judicialization of politics and judicial activism, which although they have in common the expansion of the Judiciary Power over the other powers, can not be confused, as judicial activism corresponds to a posture discretionary and pragmatic nature of judges and courts, which are based on subjective criteria at the time of rendering their decisions. However, such phenomenon should not be admitted by the Brazilian population, since it meets the democratic ideals instituted with the promulgation of the Federal Constitution of 1988. Thus, in order for the Democratic State of Law to remain, it is necessary to depart from judicial decisionismo that so much ravages the Brazilian citizenship, since it ends up blocking rights and guarantees of citizens who, disbelieving of their role in the State, remain astonished before these changes caused by the judicial activism in Brazil.
